These Conditions of Sale

These conditions of sale shall apply to all orders places with us, and shall override and supersede any Conditions of Purchase stipulated by the Buyer, unless otherwise agreed by us in writing.

Prices

Prices are those ruling at date of dispatch and are exclusive of VAT which will be charged at the appropriate rate.

Reservation of Title

All goods remain the property of Groundsman until paid in full by the original consignee, but shall be at the risk of the original consignee from the time of delivery.

Specification and Sustainability of Goods

The buyer is responsible for ensuring that goods ordered are suitable for the intended application, and any advice, information or opinion given by us is without legal responsibility. Pictures are for illustration purposes only and in some instances may differ slightly from the products supplied.

Damage or Partial Loss in Transit

Claims for shortages or damages must be made within 3 days of receipt of goods to be accepted.

Non-delivery

Claims for non-delivery must be made within 10 days of our invoice date to be accepted.

Returns

We regret we are unable to accept returns expect by prior arrangement. A handling or restocking charge may be levied if goods were correctly supplied against your order. Non catalogue items specially ordered may not be returned.

Invoices

Any dispute as to the accuracy of an invoice must be communicated to us in writing within 14 days.

Payments

Payments for approved credit accounts are net and must be received by us no later than 30 days following the date of invoice. We reserve the right to charge interest on overdue accounts at the rate of 8% above the Bank of England reference base rate calculated on a daily basis. Payment on collection or delivery is required from non account customers. A deposit may be requested for goods specially ordered.

Indemnity

We cannot be held responsible for any consequential loss of any description incurred by the Purchaser as a result of any failure or fault in the goods or for any damages or personal injuries or other losses, (howsoever) caused directly or indirectly by the goods.
